A legal point of view over spam

Now, you don't have to worry about spammer as you have legal tool to fight back these stealers. Spam is as huge crime as fraud.

To fight back these spammers a law was introduced in United States on January 1st 2004 which is known as The Can Spam Act. This law refers to non-solicited marketing mails and pornography. This law is applicable for the regulation of the right to "Opt-out" while one receives a spam. It is also applicable to some extent to the compulsion for the sender to prove an existing request for subscription for that specific message made by the receiver.

The Act considers the bulk email:

- The number of the email sent in 24 hours is more than 100 emails.

- The number for the emails sent in 7 days is more than 1,000 emails.

- The number of emails sent in 30 days exceeds 10,000 in number.

The most important thing which demands attention about Can Spam Act is; it does not prohibit the bulk email messages or unsolicited commercial messages to be sent out. All you need to follow is a set of rules. These rules to avoid being an illegal email sender or spammer are listed below:

- Avoid hiding your identity in the "From Line".

- Add your valid postal address where you can be contacted. The postal address must not be P.O.Box number.

- Avoid the false description in the "subject Line". Give the right description of the content in this field.

- Include the visible a "unsubscribe link" in your email. The link must be valid and true with the outcome of sure results.

- Always manage to process the unsubscribe request in short time. The maximum limit for the request process should be 30 days.

- In the case your email is sent to non-subscriber, add a clear statement mentioning the email purposes.

- Make sure that once the user is unsubscribed their contact information is not used for any other purpose. Ensure privacy.

The law is also applicable to the online transactions and other email relationships. The exception for such matters is made with unsubscription and physical postal address. The terms of Act " transactional" and Relationship" refer to the facility of the sent emails in commercial transactions etc.
